Mexico: new NOM regulation to become effective

The new NOM-208 will replace NOM-EM-016 and is to become effective on 8 April 2017.

Major Changes:

  1. NOM-EM-016 for spread spectrum products working on 902-928 MHz, 2400-2483.5 MHz and 5725-5850 MHz expired on 19 October, 2016. The new NOM regulation that will replace it is called NOM-208, which has been published by the official gazette (Diario Oficial de la Federación, DOF) on 7 February, and will be effective after 60 days (8 April, 2017).
  2. At present, NOM-EM-016 expired (October 19, 2016) but NOM-208 has not been enforced, the process is:
    • Test the product and submit the test report to NYCE;
    • NYCE issues IFT-008 certificate (which must be renewed to NOM-208 certificate after the enforcement thereof - the renewal takes about 10 weeks);
    • Submit the NYCE IFT-008 certificate to IFETEL, who then issues the IFT-008 certificate.
  3. After 8 April, 2017, NOM-208 will have been enforced, the new process will be:
    • Test the product and submit the test report to NYCE;
    • NYCE issues NOM-208 certificate;
    • Submit the NYCE NOM-208 certificate to IFETEL, who will then issue the IFT-008 certificate.
